These Terms of Service (“Terms”) apply to your use of the Novu Alarm website, mobile applications, products, and related services. The Novu Alarm mobile app and physical Novu Pod are referred to together as “Novu,” “Novu Alarm,” “we,” “us,” or “our.”

By accessing our website, purchasing a Novu Pod, or using the Novu Alarm mobile app, you agree to these Terms. If you do not agree, please do not use our website, app, or products.

1. About Novu Alarm

Novu Alarm is an alarm app designed to work with the Novu Pod, a passive NFC device. The app allows users to set alarms and dismiss supported alarms by physically tapping their phone to a paired Novu Pod.

The Novu Pod does not require charging and does not contain a battery, Bluetooth, Wi-Fi, or cellular connection.

2. No Account or Subscription Required

The Novu Alarm app is designed to work without requiring a user account or subscription. App settings such as alarms, labels, notes, streaks, snooze estimates, paired Pod information, and related preferences are stored locally on your device unless otherwise stated in our Privacy Policy.

3. Device Compatibility and Permissions

Novu Alarm requires a compatible mobile device and certain device permissions to function properly. Depending on your device and operating system, these may include notifications, alarm scheduling, full-screen alerts, NFC access, audio, volume, and related alarm permissions.

You are responsible for enabling the required permissions, keeping your device charged, keeping your device volume and settings configured appropriately, and testing your alarm setup before relying on it.

4. Alarm Reliability

Novu Alarm is designed to help improve wake-up consistency, but we do not guarantee that any alarm will function without interruption or error in every circumstance.

Alarm performance may be affected by factors outside our control, including your device settings, operating system restrictions, battery level, Do Not Disturb settings, notification settings, volume settings, app permissions, hardware issues, NFC availability, software updates, or user error.

You should not rely on Novu Alarm as your only alarm for critical events, emergencies, medical needs, travel, employment obligations, or other situations where a missed alarm could result in harm, loss, or damage.

5. Novu Pod Use

The Novu Pod is intended to be used as a physical alarm-dismissal device with the Novu Alarm app. You should place the Pod in a safe, accessible location away from your bed and avoid placing it somewhere that may cause injury, damage, or unsafe movement when dismissing an alarm.

If your Novu Pod contains embedded magnets, keep it away from small children, pets, medical devices, magnetic cards, and items that may be affected by magnets. The Novu Pod is not a toy.

6. Purchases, Shipping, and Returns

Purchases made through our website are processed through our online store and payment providers. Product availability, prices, shipping times, and delivery estimates may change.

Shipping and return details are provided in our Shipping Policy and Refund Policy. Please review those policies before purchasing.

7. Acceptable Use

You agree not to misuse the website, app, or product. This includes attempting to interfere with the app, bypass security or authentication features, reverse engineer protected components, use the product for unlawful purposes, or violate the rights of others.

8. Intellectual Property

Novu Alarm, Novu Pod, our logo, product designs, app designs, website content, text, graphics, images, software, and related materials are owned by us or our licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, or use our intellectual property without our prior written permission.

9. Third-Party Services

Our website and store may rely on third-party services such as Shopify, payment processors, shipping providers, app stores, analytics tools, and other service providers. Your use of those services may also be subject to their own terms and policies.

10. Privacy

Your use of Novu is also governed by our Privacy Policy. Please review it to understand how information is collected, used, and handled.

11. Disclaimer of Warranties

To the fullest extent permitted by law, Novu Alarm, the Novu Pod, our website, apps, and related services are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or perfect operation.

Some jurisdictions do not allow certain warranty limitations, so some of these limitations may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, including missed alarms, lost profits, lost opportunities, lost data, personal inconvenience, or other losses arising from your use of or inability to use Novu Alarm or the Novu Pod.

Our total liability for any claim related to a product purchase will not exceed the amount you paid for the product giving rise to the claim.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of our website, app, or products after changes are posted means you accept the updated Terms.
